than five days to go before falls right off the fiscal cliff. the senate back in session today and it's the first time the senate or house has met for business between christmas and new year's in more than four decades. president obama cut his hawaii trip short arriving in washington early today. for now, the house of representatives is not in session but we've learned those lawmakers are set to return this weekend. today the senate majority leader, harry reid, says we've just about run out of time. >> if we go over the cliff, and that's where we're headed, mr. president, the house of representatives as we speak with four days left after today before the first of the year, aren't here with the speaker having told them they'll give them 48 hours notice. i can't imagine their consciences, out wherever they are around the country and we're here trying to get something done. >> we're awaiting reaction from the senate minority leader, mitch mcconnell. when that happens we'll go live to the senate floor but a spokesman for john boehner says senator reid should talk less and legislate more.

from the fiscal cliff. sources tell nbc news party leaders in the senate are drafting a small stop-gap plan. the question is whether minority leader mitch mcconnell and majority leader harry reid can draft a bill that will pass the house. any bill that does come up for a vote tomorrow or monday will likely not address massive spending cuts but lawmakers are trying to avoid tax increases for most americans. nbc's david gregory talked to president obama about negotiations today in an interview that airs on "meet the press" tomorrow. the president continues to be optimistic but he, i think, in part is doing the interview on "meet the press" because he wants to keep the pressure on republicans to get something done and made very clear in the course of the interview that there's a political cost to be paid if there is not a deal. you can see the full interview with the president from the white house tomorrow morning on "meet the press" at 10:30 right here on nbc 4. >>> some good news for former president george h.w. bush tonight. he's out of intensive care. the 88-year-old's been in the

to avoid the fiscal cliff. both houses of congress are meeting in a rather sunday session. the senate convenes aat 1:00 eastern and the house at 2:00. our chief white house correspondent jessica yellen with the look at the chances for a deal and what's on the table. >> here in washington there is still hope a deal can be cut in time to avert the fiscal cliff. on saturday the president was at work here in the white house, but all eyes were on the senate where negotiators were trading deal points and revenue figures to try to reach an agreement all sides can stomach. the baseline for the president, any bipartisan bill has to extend unemployment insurance that would affect some 2 million americans, and increase taxes for the highest income earners. negotiators can still work out exactly where that tax increase would hit and whether they would halt an increase in the estate tax. in case those discussions break down, the president has asked democratic leader harry reid to prepare a separate bill to put on the floor of the senate that would raise taxes on households that earn $250,000 or mo

this christmas break. no movement moving forward on these fiscal cliff talks. the focus will shift to the senate. they have to try to craft something together that will pass both the house and the senate. so, the burden is now on them to try to strike some sort of a deal. that's because on friday before congress left for christmas, the house was unable to get any sort of a deal passed through. >> and, reena, give us a play-by-play. what can we expect this week? where will the white house be focusing their efforts? >> reporter: right. as i mentioned, capitol hill, now, taking the emphasis over at the senate side. the other concern that the white house does have is to make sure that they come to their different party lines. the democrats want to see, obviously, the middle class not faced with any sort of tax hike, which there are $500 billion worth of tax hikes expected on january 1st. republicans are saying that spending cuts. they want to see more of that. and democrats do not want to go off of their focus on where they are right now, to get to that point. that's really a big divide that both th

was modestly optimistic that the january 1 deadline for the fiscal cliff could be averted, but that is contingent on a vote in the senate on a compromise bill, and that will have to get an up or down vote. there is a majority for that, with some tax increases for upper-income people. the question is what level would be acceptable to republicans. more crucial to that is, whatever the senate proposes and passes on to the house, will it be acceptable to the majority of republicans in the house, who control that body? if it is not, we may be having another confrontation, and go past the january 1 deadline, and we could see those tax increases go into effect. again, there is the fallback position. if the pressure on the republicans is great enough, they may have to change their position after january 1. congress can always pass something retroactively, which would have an effect retroactively. but the damage would be done to the republican image of being a constructive element in these negotiations. >> the indian student whose gang rape sparked mass protest has died in hospital

is the tax part of the fiscal cliff. as you know, the senate on a bipartisan basis has already passed a bill. so that has to be the foundation of more than the senate does. when you say the action begins in the senate, that's because speaker boehner has declared that the house will not even vote on that compromised senate bill. that's a choice that he's made. he's said that he's not going to allow a vote to come up in the house unless half of the republican members support it, even though it might have support with the full majority in the house. in other words, i believe we could take up the bill that prevents the fiscal cliff and get it passed in the house. the only thing preventing us from doing that is that the speakers refuse to allow a vote on that. people need to understand that that plan would provide tax relief to 100% of american families on their first $250,000 of income and for folks above that level, they would be paying a little more on the amount of their income above $250,000. that was the bipartisan senate plan. we should have a vote on a plan like that here in the house. >>
